Refund Policy

DEFINITIONS: Parties - The two parties who are entering into this agreement are "Charterer" and "Charter Company." Charterer - The individual or entity requesting the charter service. Charter Company - The Company providing the service known as "Charter Airlines LLC".

GENERAL: Charter quotes are aircraft type specific; should the need arise to change aircraft, cost may vary accordingly. Charterer shall be informed of any such change prior to flight and the amount of additional cost, if any. The quote is based upon aircraft and crew availability and is valid for 24 hours. Upon acceptance of terms and conditions listed herein, this document becomes a legal and binding contract between the two parties.

PRICES, PAYMENTS AND CANCELLATIONS: All prices quoted herein are accurate on the date quoted, are subject to change without notice, and are valid for 24 hours. Full payments must be secured prior to service date. For round trips, once booked the cancellation penalty is 25% of the total quote amount. The cancellation penalty is 50% of the total quote amount if the flight is cancelled within 72 hours of the departure date, 75% of the total quote amount if the flight is cancelled within 48 hours of the departure date and 100% cancellation penalty of the total quote amount if cancelled within 24 hours of the departure date.

ALL “ONE WAYS” OR “POINT TO POINT PRICING” (INCLUDING MULTI LEG ONE WAYS) ARE SUBJECT TO A 100% CANCELLATION PENALTY OF THE TOTAL QUOTED AMOUNT FROM THE TIME OF BOOKING. A no show will be charged the full amount of the charter quote. Past due amounts are subject to the maximum rate allowed by state law plus collection costs, attorney fees and court costs. Brokers completing an annual Charter Company Exemption Certificate shall be responsible for the collection/remittance of all applicable Federal and/or State taxes and fees including but not limited to excise tax, arrival/departure fees, Customs and Immigration Air Passenger User fees, and USDA/APHIS fees.

FBO’s: Charter Airlines LLC reserves the right to choose the Fixed Based Operators at each location. If the Charterer requires the use of alternate FBO’s at any airport, Charter Airlines LLC reserves the right to adjust the pricing.

Excessive wait time charge: Charter Airlines LLC, reserves the right to charge $250.00 for each hour of excessive wait time once proposed departure time has been exceeded by 2 hrs.

DOCUMENTATION: Photo ID's are required prior to flight. Additionally, official travel documents (passports, visas, etc,) are the responsibility of each passenger.

ITINERARY CHANGES and TRANSMITTAL OF CHANGES: Itinerary changes are permitted, but subject to aircraft and crew availability and subject to price adjustment. Notification of changes and/or cancellations must be in writing and transmitted by email at chartersales@flycharterairlines.net within the cancellation time frame listed above.

RESPONSIBILITY: Charter Company shall not be liable for any injury, damage, loss, expense, indirect, special or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for your trip or by accident, delay, flight schedule, change, cancellation, sickness, weather, strikes, war, quarantine, or any similar cause. Our liability shall in any case be limited to the amount paid to us, and any claim shall be adjudicated in and governed by the laws of the state Florida.

PARTIAL COMPLETION OF FLIGHTS: Charter Company is not liable for expenses incurred for replacement transportation in the case of mechanicals, (in such cases our charges apply only on portions of flight completed. If a flight does not reach its destination due to weather, charges apply to any destination reached and return flight of the aircraft and crew (with or without passengers) to home base. In the case of mechanicals Charter Airlines LLC may at its option provide substitute transportation which shall be charged as an additional fee to Charterer. In such cases Charter Company's original charges apply only on portions of flight completed.

OPERATIONAL: All flights are operated by FAR Part 135 air carriers that exercise full operational control of charter flights at all times. Charter Airlines LLC is an FAR Part 135 air carrier, operating in full compliance with all FAA safety standards. Some flights will be operated by other FAR Part 135 air carriers that have been certified to provide charter services arranged by Charter Airlines LLC and meet FAA Standards.

Quoted amount is subject to change due to itinerary revisions, additional expenses incurred including but not limited to catering, ground transportation, de-icing and hangar fees for inclement weather. De-icing and or hangar charges incurred when repositioning the aircraft for a client flight will be the responsibility of the client.
