The Undersigned is engaged in the business of transporting persons or property by air. As such, amounts paid to Charter Airlines LLC are subject to the designated Federal Excise Tax provisions under §4261 & §4271 of the Internal Revenue Code of 1986 (Part 2, Chapter 33, Subchapter C, Parts I & II).
The Undersigned acknowledges and agrees that it has engaged (or intends to engage) Charter Airlines LLC to operate certain flights to transport the Undersigned’s third party customers and/or their property and/or cargo on aircraft operated by Charter Airlines LLC (the “Flights”). This certificate shall apply to all flights and to all passengers, property and cargo transported thereon.
The Undersigned further acknowledges and agrees that, with respect to all Flights and to all passengers, property and cargo transported thereon, it is the Undersigned’s sole and exclusive responsibility to collect, account for and pay over to the Internal Revenue Services, all applicable Federal Excise Taxes described in IRC §4261 and/or §4271, and Charter Airlines LLC shall be exempt from having to collect, account for and pay over to any person, entity, or governmental agency any of the foregoing taxes, fees, charges or other amounts.
The Undersigned further acknowledges and agrees that (i), in connection with the Flights, the Undersigned is not an agent of Charter Airlines LLC, and (ii), the Undersigned will provide to Charter Airlines LLC, upon written request, evidence of the Undersigned collection and payment of the taxes, fees and charges described above (but absence of any such request shall not affect the blanket exemption provided for herein or otherwise affect any of the rights, duties or obligations of Charter Airlines LLC).
This certificate is valid between the parties for each flight as it occurs.
